Terms of Use

1. Acceptance of terms

These Terms of Use (the "Terms") constitute a binding agreement between you and GTRYP LLC, a limited liability company registered in North Dakota, United States, with its registered office at 1681 3rd Ave W, Dickinson, ND 58601, US ("GTRYP", "we", "our" or "us"). By accessing or using the website located at gtryp.com or any of the related services (collectively, the "Services"), you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference.

If you do not agree with any part of these Terms, you must not use the Services. If you are using the Services on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms, and "you" as used in these Terms will refer to that organisation.

2. Editorial nature of the Services

GTRYP is an independent editorial publication. The Services consist of written articles, photography, audio, video, newsletters, indexes, guides and related editorial materials. GTRYP is not a travel agency, tour operator, booking platform or accommodation provider. We do not sell travel products, we do not arrange itineraries, we do not act as an intermediary between you and any third party service provider that may be mentioned in our articles, and we do not receive compensation from the businesses we describe.

The recommendations we publish are the personal views of our editors and contributors, based on their own visits and research at a particular moment in time. They are not warranties, they are not offers, and they are not travel advice within the meaning of any applicable regulatory regime. Prices, hours, transport schedules, accommodation availability, safety conditions and other practical details change frequently, and it is your responsibility to verify them before you travel.

3. License to use the Services

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal, non-commercial use. You may view articles, share links to them on social media, and print or download copies for personal reference. Any other use, including reproduction, distribution, translation, framing, mirroring, republication or use in any commercial product or service, requires our prior written consent.

The license granted under these Terms terminates automatically if you breach any provision of these Terms. On termination, you must immediately cease all use of the Services and destroy any copies of content in your possession.

4. Accounts

The Services do not currently require an account for access to editorial content. If we introduce account-based features in the future, additional terms will apply, and you will be responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

5. Intellectual property

All content on the Services, including articles, photographs, illustrations, graphic design, logos, video, audio, layouts, source code and databases, is owned by GTRYP LLC or its contributors and is protected by copyright, trademark, database and other intellectual property laws. The GTRYP name and the mark Guide To Rare Places are trademarks of GTRYP LLC. All rights not expressly granted to you under these Terms are reserved.

You may not reproduce, republish, distribute, sell, license, translate, adapt, modify or create derivative works of any content on the Services without our prior written consent. Short quotations of no more than two hundred words per article are permitted for the purposes of commentary, criticism, review or news reporting, provided that you credit GTRYP and, where applicable, the individual contributor, and that you include a working link to the original article.

The use of any automated system, including scrapers, crawlers, spiders or artificial intelligence training pipelines, to access or extract content from the Services is prohibited without our prior written consent.

6. User submissions

When you send us a message, a place suggestion, a Careers application, a correction, or any other submission through the Services (each a "Submission"), you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sub-licensable license to use, adapt, reproduce, translate and publish that Submission in connection with the Services and our editorial work. You represent and warrant that you have the right to make the Submission, that it is accurate to the best of your knowledge, and that it does not infringe any third party rights or violate any applicable law.

You may not submit any content that is unlawful, defamatory, harassing, threatening, obscene, hateful, invasive of privacy, or otherwise objectionable, or that contains malware, links to malware, or advertising for third party products or services.

7. Prohibited uses

You agree not to use the Services in any manner that: (a) violates any applicable law, regulation, or third party right; (b) infringes the intellectual property or other rights of any person; (c) interferes with the security or operation of the Services; (d) involves automated scraping, harvesting, indexing or extraction of content without our written consent; (e) impersonates any person or misrepresents your affiliation with any person; (f) transmits any malware or malicious code; (g) attempts to gain unauthorized access to any part of the Services or the systems on which they are hosted; or (h) uses the Services in any manner that could reasonably be expected to cause damage to our reputation.

8. Third party links and content

The Services contain links to third party websites, businesses or resources. GTRYP does not control these third parties and is not responsible for their content, availability, privacy practices, safety, or the goods or services they provide. The inclusion of a link does not imply endorsement, and your use of any linked resource is at your own risk and subject to that resource's own terms.

GTRYP may include third party embedded content, such as maps, video players or social media widgets. These embeds may collect information about your visit to the pages on which they appear, subject to the third party's own privacy notice.

9. Disclaimers

The Services are provided on an "as is" and "as available" basis, without warranty of any kind. To the fullest extent permitted by law, GTRYP disclaims all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, non-infringement, or availability.

GTRYP does not warrant that the Services will be uninterrupted or error free, that defects will be corrected, or that any content is accurate, complete or current at any given moment. Travel involves risk, and you should exercise your own judgment before acting on any information from the Services. GTRYP is not responsible for any loss, injury, damage or expense that arises out of your travel or your reliance on any content on the Services.

10. Limitation of liability

To the fullest extent permitted by law, in no event shall GTRYP LLC, its officers, directors, employees, contributors, agents or licensors be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill, data or use, arising out of or in connection with your use of the Services, whether based on contract, tort, statute or any other legal theory, and whether or not we have been advised of the possibility of such damages.

Our aggregate liability to you for any and all claims arising out of or in connection with the Services shall not exceed one hundred United States dollars.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability will be limited to the maximum extent permitted by law.

11. Indemnity

You agree to indemnify, defend and hold harmless GTRYP LLC, its officers, directors, employees, contributors and agents from and against any claim, demand, loss, liability, damage, cost or expense (including reasonable legal fees) arising out of or in connection with your use of the Services, your Submissions, or your breach of these Terms or of any applicable law.

12. Termination

We may suspend or terminate your access to the Services at any time, without notice, if we reasonably believe that you have breached these Terms or that your continued access poses a risk to the security or operation of the Services. On termination, all provisions of these Terms that by their nature should survive termination will do so, including intellectual property, disclaimers, limitations of liability and governing law.

13. Governing law and jurisdiction

These Terms are governed by the laws of the State of North Dakota, United States, without regard to its conflict of laws principles. Any dispute arising out of or in connection with these Terms or the Services shall be submitted to the exclusive jurisdiction of the state and federal courts located in Stark County, North Dakota, and you consent to the personal jurisdiction of those courts. Nothing in these Terms prevents a consumer resident in a jurisdiction that provides mandatory consumer protection from bringing proceedings in the courts of that jurisdiction.

14. Changes to these Terms

We may modify these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. For material changes we will post a prominent notice on the site and, where we have your email address, we will notify you by email. Your continued use of the Services after the effective date of any modification constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Services.

15. Miscellaneous

These Terms, together with our Privacy Policy and any other legal notices published by us on the Services, constitute the entire agreement between you and GTRYP concerning the Services. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any provision of these Terms will not be deemed a waiver of that provision. You may not assign these Terms without our prior written consent; we may assign these Terms without restriction.
